Terms of Service
Darren Stanley Photography
1. Nature of Service
Darren Stanley Photography provides event photography services at public or semi-public events. The Photographer is not contracted by, employed by, or acting on behalf of event organisers unless explicitly stated in writing.
Images captured may be made available for purchase by event attendees and participants.
2. Image Sales & Delivery Platform
Images from events are uploaded to an online gallery hosted on Pixieset or similar platform.
These galleries are made available for individuals to:
View images from the event
Purchase digital downloads and/or prints
Access to galleries may be restricted or password protected where required.
3. Copyright & Ownership
All images remain the exclusive copyright of Darren Stanley Photography at all times.
No ownership is transferred through viewing or purchasing images.
Purchased images are licensed, not sold in ownership.
4. Usage Licence (Purchased Images)
Upon purchase, the customer is granted a non-exclusive, non-transferable personal use licence.
Permitted use:
Personal social media sharing (with credit where reasonable)
Personal printing
Private use
Not permitted:
Commercial use (advertising, business promotion, resale)
Redistribution or resale of files
Removal of watermark or metadata (if present)
Claiming authorship of the image
Commercial use requires separate written licensing.
5. Event Photography Conditions & Consent
By attending an event where Darren Stanley Photography is present, individuals acknowledge that:
Photography is taking place throughout the event
Images may include attendees and participants
Images may be published in online galleries for purchase
Where required, event organisers are responsible for informing attendees that photography is occurring.
Darren Stanley Photography operates under the assumption of reasonable expectation of photography in public or ticketed event environments, unless a formal opt-out is provided.
6. Opt-Out / Privacy Requests
Individuals who do not wish to appear in photographs must notify the Photographer prior to or during the event where reasonably possible.
Where an image is already captured:
Reasonable efforts will be made to remove or avoid publishing identifiable images upon request
Removal requests after publication will be assessed on a case-by-case basis
Complete exclusion cannot be guaranteed at large-scale events.
7. No Guarantee of Coverage
Darren Stanley Photography does not guarantee:
Coverage of specific individuals, moments, or performances
Minimum number of images per attendee
Capture of all participants equally
Image capture is determined by artistic discretion, positioning, timing, and event conditions.
8. Pricing & Purchases
Prices for digital downloads, prints, or packages are displayed within each gallery.
All purchases are final unless required otherwise under New Zealand consumer law.
9. Liability
Darren Stanley Photography is not liable for:
Missed images of specific individuals or moments
Event restrictions imposed by venues or organisers
Lighting, weather, or environmental conditions
Technical failures beyond reasonable control
In the case of total image loss from an event, liability is limited to refund of any affected purchases.
10. Archiving
Images are stored for a limited time after each event (typically 2 months)
After this period, images may be permanently deleted
Redelivery after deletion is not guaranteed
Customers are responsible for downloading purchased files.
11. Third Parties
Darren Stanley Photography is independent and not responsible for:
Event organisation or management
Venue policies or restrictions
Attendee behaviour
12. Changes to Terms
These Terms may be updated at any time. The version in effect at the time of image capture applies.
13. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes are subject to the jurisdiction of New Zealand courts.
